Bank account frozen after a job scam in Taiwan: 8 Steps

Bank account frozen after a job scam in Taiwan? First, ask your bank what restriction applies, identify the authority handling the case, and preserve the recruitment messages and transaction records. Being investigated does not automatically mean you committed fraud or money laundering. However, an account restriction and a criminal investigation may require separate responses.A supposed employer may ask you to receive customer payments, withdraw cash, purchase cryptocurrency, or hand over your bank card. If those transactions involve fraud proceeds, your account may become part of an investigation.

👨🏻‍⚖️Chien Sheng International Law Firm assists with account-related criminal cases, evidence review, police interviews, and applications concerning banking restrictions. The appropriate approach depends on what you actually did, what you knew, and the available evidence.

1. Bank account frozen after a job scam in Taiwan? Identify the restriction first

💡“Frozen account” is an everyday description rather than a single legal category.

➠A warning account, known as 警示帳戶, is an account reported to a bank by a court, prosecutor’s office, or judicial police authority for a criminal investigation. Its transaction functions are suspended.

➠Other accounts belonging to the same holder may become derivative controlled accounts, or 衍生管制帳戶. Their restrictions differ from those applying to the original warning account.

➠Banks may also restrict transactions because of abnormal activity without an account having been formally designated a warning account. Separate seizure orders can create additional restrictions. law.fsc.gov.tw

🚨Ask the bank:

  • What is the exact account status?
  • Which authority issued the report or order?
  • What case number or reference can be provided?
  • Are several accounts or reports involved?
  • What documents are needed to clarify the restriction?

Keep a written record of the information received. The correct application route depends on the actual reason for the restriction.

2. Recognize recruitment arrangements that expose you to risk

▫️Receiving and forwarding “customer payments”

A recruiter may describe personal-account transfers as payment processing, customer refunds, purchasing work, or administrative support. You may be instructed to forward each deposit immediately and retain a small payment.

➥A job title does not establish that the underlying transactions are legitimate. Preserve the instructions explaining why money was sent to you and where you were told to send it.

▫️Handing over cards, passwords, or verification access

Providing an account number for genuine payroll purposes differs from giving another person access to operate the account.

➥Requests for an ATM card, PIN, online banking password, verification code, or control of a linked device require particular caution. An investigation may examine who actually controlled each transaction.

▫️Buying cryptocurrency or handling foreign exchange

Some supposed jobs involve receiving Taiwan dollars and sending equivalent cryptocurrency to specified wallets. Others are presented as currency exchange or investment assistance.

➥These arrangements may raise issues beyond account provision, depending on the activity. Keep exchange records, wallet addresses, transaction identifiers, and the recruiter’s instructions.Do not assume that sending an equivalent value proves every part of the arrangement was lawful.

3. Does being deceived automatically make you a fraud accomplice?

No. Fraud-related liability cannot be established merely by showing that an account received a victim’s money.Under Criminal Code Article 13, intent encompasses both deliberately bringing about criminal facts and accepting their foreseen occurrence. An allegation of intentionally assisting fraud therefore requires an examination of the person’s actual knowledge and intent. law.moj.gov.tw

📝Relevant questions include:

  • How was the job advertised and explained?
  • Did the stated business activity match the transfers?
  • What warnings or unusual instructions did you encounter?
  • Did you continue after learning of suspicious activity?
  • Did you receive payment or suffer a loss yourself?

➥Saying “I did not know” does not resolve those questions by itself. Equally, conduct that appears careless or unusual does not automatically prove criminal intent.

Your explanation should be supported by records created at the time. Being a scam victim and being accused of assisting the scheme can occur in the same investigation; each alleged offense still requires its own legal analysis.

4. Account provision and money laundering involve separate legal questions

▫️Restrictions on providing accounts to others

Money Laundering Control Act Article 22 regulates providing financial, virtual-asset service, or third-party payment accounts for another person’s use. It contains exceptions for ordinary commercial or financial practices, trust between relatives or friends, and other legitimate reasons.

A violation may lead to a police admonition and financial-service restrictions. Specified circumstances—including agreed or received consideration, three or more accounts, or a qualifying repeat violation within five years—can attract up to three years’ imprisonment, detention, or a fine of up to NT$1 million, with a fine also potentially imposed alongside imprisonment. law.moj.gov.tw

➥This provision must be assessed separately from aiding fraud. Reviewing only whether investigators can prove knowledge of a particular scam may leave another allegation unanswered.Merely supplying ordinary payroll details is not automatically equivalent to handing an account over for someone else to use. Conversely, retaining your bank card does not automatically exclude liability if you knowingly process criminal funds.

▫️Money-laundering allegations

Receiving, withdrawing, converting, or forwarding funds may prompt a separate examination under the Act’s money-laundering provisions.

➥The prosecution must establish the applicable conduct and mental requirements. An account’s involvement in a payment chain does not replace that analysis. The law applicable to the conduct date must also be checked.

5. Take immediate steps to protect your account and evidence

Stop following the recruiter’s instructions to receive, withdraw, convert, or forward suspicious payments. Contact the bank through an official channel to report the concern and discuss securing account access.Do not transfer unfamiliar deposits to an account supplied by a stranger claiming to arrange a refund. Ask the bank or investigating authority how disputed funds should be handled.

🔎Preserve:

  • The original job advertisement and recruiter’s profile.
  • Complete conversations, including voice messages.
  • Contracts, task descriptions, and payment promises.
  • Bank statements, withdrawal records, and transfer receipts.
  • Cryptocurrency exchange records, wallet addresses, and transaction identifiers.
  • Bank alerts, police notices, and reporting documents.

➥Create a timeline showing recruitment, account access, relevant payments, the first warning sign, and your subsequent actions.

Do not delete conversations or alter screenshots. If you need to block harassment, preserve the available evidence first. Avoid contacting other suspects to coordinate accounts of events.

6. Prepare for police questioning with records rather than guesses

Take a police notice seriously. Confirm the station, officer, case reference, appointment, and capacity in which you are being asked to attend. If you cannot attend, contact the authority promptly about rescheduling.Taiwan’s criminal procedure provides rights concerning silence, legal representation, and the investigation of favorable evidence.

👨🏻‍⚖️During questioning, distinguish:

  • What you personally did.
  • What the recruiter told you.
  • What you knew at the time.
  • What you learned only after the account restriction.

➥If you cannot remember a date or amount, say so and refer to records where appropriate. Do not adopt a suggested answer simply because you want to finish quickly.

Read the written statement before signing. Request corrections if it omits an important qualification or records an uncertain answer as a definite admission.A lawyer can help review the allegations, organize evidence, attend questioning where permitted, and identify inaccuracies. Representation does not guarantee that questioning or other lawful investigative measures will stop.

7. Check whether the account restriction can be removed

Sometimes a warning designation can be removed before the criminal case ends, but the route depends on the facts.

Official police application guidance provides procedures for specified circumstances, including certain commercial disputes and account misuse without account handover. However, that special procedure expressly excludes accounts handed over for job applications, loan arrangements, account rental, or similar reasons. A recruitment-related handover therefore cannot automatically be treated as eligible for that early-removal route. nh.police.gov.taipei

Ask which procedure applies and what supporting documents are required. Keep proof of submission and follow up on whether the relevant authority has notified the bank. For a derivative controlled account, counter transactions may remain possible subject to the bank’s review of their legitimacy. This does not mean the original warning account can necessarily be used or that salary deposits will be accepted normally. law.fsc.gov.tw

➥A separate police admonition, seizure order, or other restriction may require additional action. Obtaining a non-prosecution disposition does not necessarily restore every account function immediately.

8. Understand how a criminal defense lawyer can assist

The first task is to identify the alleged conduct: providing account access, receiving funds, withdrawing cash, converting assets, or helping someone else move money.

Depending on the agreed scope, Chien Sheng International Law Firm can assist with:

  • Reviewing recruitment messages and payment instructions.
  • Comparing bank records with cryptocurrency transfers.
  • Clarifying account control and the client’s actual role.
  • Examining the legal basis for each allegation.
  • Preparing for police and prosecutorial questioning.
  • Assessing warning-account applications and separate admonition issues.
  • Presenting favorable evidence and defending court proceedings.

➥Where the evidence supports the position, counsel may seek a non-prosecution disposition or an acquittal. Deferred prosecution, sentencing submissions, and a suspended sentence involve different conditions and procedural stages.

Frequently Asked Questions

Q1. Bank account frozen after a job scam in Taiwan: does this mean I am guilty?

No. A restriction is not a conviction. However, you should clarify the account status and respond to any investigation with complete records.

Q2. I only provided an account number for salary. Is that automatically illegal?

No. Ordinary payroll information differs from giving another person operational control. The actual arrangement and your conduct must be examined.

Q3. I never received a commission. Does that rule out criminal liability?

No. Lack of payment may be relevant, but it does not automatically exclude fraud assistance or money laundering. Each offense has separate requirements.

Q4. Can I remove the warning designation by showing that I was a job-scam victim?

Not necessarily. The account-handover facts and applicable removal procedure matter. The special route for misuse without handover cannot automatically be applied to recruitment-related handover cases.

Q5. Can I withdraw living expenses from another account?

Possibly through counter services, depending on its status, the bank’s review, and other legal restrictions. Confirm the requirements before relying on access.

Q6. Can a lawyer guarantee dismissal or immediate account access?

No. A lawyer can examine the evidence and pursue appropriate applications and defenses, but the responsible authorities determine the outcome.
